    Synopsis

    Digital communications, records and surgical tools have had a tremendous impact on the practice of oral and maxillofacial surgery. Bad online reviews can devastate the marketing of a practice. Texting, e-mails, and video uploads can create unanticipated liability for claims involving allegations of malpractice and confidentiality violations. Understanding a surgeon's legal rights, obligations and defenses is critical in avoiding such claims and establishing systems to protect productivity.

    Learning Objectives
    1. Describe the laws for the use of digital records, social media, and communications;
    2. Recognize the legal exposures for claims of malpractice created by digital records, imaging and communications; and
    3. Discuss the law of marketing on Websites and social media such as Facebook, and the attendant issues of patient confidentiality and HIPAA compliance.
